Identification Charge Dismissed
Name changes can be very confusing. For a San Diego firefighter trying to claim his real name it almost cost him a jail sentence. Fortunately, lawyers from KSPLC were able to unravel a legal mess and right a wrong.
he firefighter grew up believing his name was one name but as an adult he learned what his rightful birth name actually was. He began using his real name while living in two other states and when he returned to California he went to the Department of Motor Vehicles to obtain a California driver’s license. He dutifully explained to the DMV clerk the situation and was given a driver’s license in his birth name.
Then, the dreaded bureaucracy got involved and the situation went downhill. Some DMV official later searched the data for name duplications and noticed two names with the same birth date and other statistics and an investigation was conducted because our client’s driver’s license was a special one required for firefighters. He came to us for help and before DMV filed charges we attempted to resolve the issue with the DMV investigator by producing all the proper documentation.
Despite this hard work the case was referred to the District Attorney’s Office, which filed criminal charges and our client was arrested and booked. Finally, after we began similar discussions with prosecutors wiser heads prevailed and the charges were dismissed.
