A Jury Decided $16 Million Verdict for Couple who Lost their Baby at Childbirth
Back in September the public heard about the child that died during delivery. A jury reached a decision resulting in a multi-million dollar verdict in favor of the family that lost their child.
The trial lasted for nine weeks and cane to an end last Friday afternoon. The jury announced that they had sided with Teresa and Robert Bailey and awarded them over $16 million.
The plaintiff’s attorney claimed that the hospital staff did not act upon the warning signs when Tyler Bailey became stuck in the mother’s birth canal.
The jury determined that the defense had “misrepresentation and intentional concealment.”
Most of the $16 million verdict was based on the jury’s determination that Dr. Arturo Mendoza, Director of Pathology for Sharp Mary Birch Hospital, was “reckless” and “without regard to the truth” when he performed the child’s autopsy.
In 2004 the Bailey’s were expecting their first son, Tyler Steven. Teresa had to go into the hospital early because her amniotic fluid was very low. Tyler was born the next morning. He was not breathing when he was born and died a short while later.
Bailey’s attorney claims that Tyler died of cord compressions because of lack of proper medical response although his death certificate says he died of an unspecified respiratory disorder.
